The Personal Property Security (PPS) Registrar

Mr David Bergman is the General Counsel and Registrar of Personal Property Securities. His office is located within the Insolvency and Trustee Service Australia.

The Registrar of Personal Property Securities is appointed by the Attorney-General and engaged under the Public Service Act 1999. xe Registrar administers the Personal Property Securities Register in compliance with the Personal Property Securities Act 2009 and Regulations. The Registrar has the power to do all things necessary or convenient to be done in connection with the performance of his or her functions.

Prior to the PPS Register commencement, David Bergman was responsible for implementing the PPS Register and assisting industry with the transition to the new system. Previously he has been responsible for advising the Australian Government on bankruptcy law reform. David Bergman was also Acting Chief Executive of the Insolvency and Trustee Service Australia and Inspector General in Bankruptcy.

Assisting industry

To assist industry with the transition to PPS reform, it was important for us to find a way to bring information about how PPS reform relates to the business environment to small business and their professional advisors. 

The PPS reform audience includes:

  • small to medium enterprises and their advisors
  • more than 2 million small to medium enterprises in Australia
  • great diversity of industry sectors
  • wide  geographic spread of businesses and business advisors

The PPS Road Show 2011

The PPS Road was designed to provide presentations about the reform at the local level. Held in May and June 2011, the PPS Road Show included a total of 70 presentations in Metropolitan and regional Australia where approximately 1,374 people attended. The presentations were mainly attended by subject matter experts, lawyers, brokers, bank employees and government agencies.

Whilst small to medium enterprises did not represent the majority of attendees, the PPS Road Show successfully partnered with organisations such as Australian state and local government agencies, Business Enterprise Centres, Australian Chamber of Commerce and Industry, National Institute of Accountants, Certified Practising Accountants of Australia and state and territory regional chambers of commerce who then used their contact base, which included small to medium enterprises, to disseminate information.

The PPS Registrar made an abridged version of the Road Show presentation in video format and made this available on the PPS website in July 2010.
