As a noticeboard of security interests in personal property, it is important for the PPS Register to contain accurate information. Whether buying, leasing, or lending against personal property, anyone searching the PPS Register needs to be able to see if an item of property has an interest registered against it.

If somebody’s name is spelled incorrectly or the serial number of a particular item of property (such as a motor vehicle) is entered incorrectly, a search of the PPS Register may not find details of the registered security interest. This could have adverse consequences for the secured party, or for the person intending to take an interest in the property.

A secured party can update a registration

If a secured party notices mistakes in a registration, they can amend the registration in certain circumstances.

The secured party can access the registration by entering in the registration number and either:

  • the registration token, or
  • the secured party group access code.

Once the registration has been accessed, the secured party group can then amend:

  • grantor details (this is done by adding a grantor, and removing the grantor with incorrect details)
  • non-serial number descriptions of the collateral
  • the secured party group details (this is done by updating the secured party group details, or creating a new secured party group with the correct details and transferring the registration to that new secured party group), and
  • the end date of the registration.

A registration cannot be changed completely. You cannot amend:

  • the collateral class, or
  • the serial numbers of collateral where it has been registered by reference to the serial number(for example, the VIN of a motor vehicle).

Amendment demands

If a grantor or another person with an interest in the collateral notices mistakes in a registration, there is a process set out in the Personal Property Securities Act 2009 (Cth) where they can require the secured party (the person or organisation that would have created the registration) to amend the registration. The notice given to the secured party is referred to as an amendment demand .
